For cosmetic softgels entering the EU, the first thing that stalls isn't production — it's compliance paperwork. And the problem usually surfaces at the worst possible moment: goods are already manufactured, but the CPSR isn't finished, or there's no EU Responsible Person in place to file the CPNP notification.
Trap 1: Treating the CPSR as something the factory can issue
The CPSR (Cosmetic Product Safety Report) is required under EU Regulation 1223/2009. Both Part A and Part B must be signed by a qualified safety assessor with a background in pharmacy, toxicology or a related field. A factory's R&D team can prepare the technical data, but the signing responsibility does not sit with the factory.
This means: if your OEM says "we handle the CPSR," you need to clarify whether they have an in-house or partner safety assessor, or whether they're simply forwarding documents. A real assessor typically needs the full ingredient list, MSDS, microbiological test reports and stability data — missing any one of these blocks the report.
Trap 2: The EU Responsible Person must be appointed before placing on the market
Every cosmetic product placed on the EU market must have a Responsible Person based within the EU. The Responsible Person's name and address must appear on the product label, and they carry legal liability for the product's compliance.
The practical problem: many Chinese brand owners assume the OEM factory can act as the Responsible Person. But if the factory has no EU legal entity, it cannot take on that role. The brand must appoint an EU-based Responsible Person itself, or engage a service provider. This step involves a separate contract and cost, and it must be completed before the CPNP notification.
Trap 3: CPNP notification isn't "submit and done"
The CPNP (Cosmetic Products Notification Portal) is the EU's cosmetic notification system. Before a product is placed on the EU market, the Responsible Person must complete the CPNP notification.
The critical timing point: CPNP notification requires the CPSR to be complete, the Responsible Person to be appointed, and label information to be finalized. If any one of these three is missing, the notification cannot proceed. And only after notification is complete can the product legally enter the EU market.
If you follow a "produce first, fix compliance later" sequence, goods can arrive at an EU port with the CPNP still incomplete — leaving them stuck in a warehouse while storage costs and delays accumulate on the brand's side.
Trap 4: Vegan certification isn't just a label claim
Demand for vegan and vegetarian cosmetics in the EU and UK keeps growing. But for softgel products, the capsule shell material determines whether a vegan claim is even possible.
Gelatin shells are derived from animal collagen and cannot obtain vegan certification. If the product targets the vegan market, you must switch to a plant-based shell such as HPMC — and the entire production run needs to be segregated from lines handling animal-derived ingredients to pass a certification body's audit.
This decision has to be made at the formula and packaging confirmation stage. Once production is complete, there's no way to retroactively adjust it.
A countdown timeline for EU compliance
Working backwards from your target launch date:
- At least 3 months before launch: confirm formula, capsule shell type and target market
- At least 2 months before launch: engage the safety assessor and prepare the technical data for the CPSR
- At least 6 weeks before launch: appoint the EU Responsible Person and finalize the contract
- At least 4 weeks before launch: complete CPSR signing
- At least 2 weeks before launch: complete CPNP notification
- At least 1 week before launch: confirm labels include Responsible Person details and required markings
Running compliance in parallel with production — rather than sequentially — is what prevents the situation where goods are ready but the paperwork isn't.
