UK SCPN Notification for Imported Cosmetics

Brands that have just finished setting up a European notification often assume the United Kingdom is included. It is not. Since the market separated, the notification route & the party accountable in the market are separate as well, & a product that is correctly filed for one route is not filed for the other. The gap is invisible on the pack, which is what makes it easy to miss.

This article covers how imported cosmetics are handled on the United Kingdom route: what a notification record holds, who submits it, what has to be true before the product goes on sale, which fields are easiest to get wrong, when a change to a formula or a name needs a fresh filing, & how the position in Northern Ireland differs. It ends with the records worth keeping & what to put in a brief so the notification lands on time.

Why the United Kingdom route is separate

After the market separation, the United Kingdom operates its own notification service for cosmetics, & it is not connected to the European portal. A filing made in one system does not appear in the other, & the responsible person named in one system is not the party accountable under the other. For a brand selling into both, that means two filings, two named parties, & two sets of records.

The practical effect appears at the point where a buyer asks for proof. A United Kingdom retailer or marketplace will ask for confirmation of a national notification, & a European confirmation will not satisfy the request because it was made in a different system under a different regime. Sellers who discover this after a listing is rejected lose a week to set-up rather than a day.

A second consequence is that the pack has to carry the right party for each destination. Where a brand sells into both markets using one artwork file with a single address block, at least one of the two is wrong. The usual solutions are separate artwork for each destination, or an address block that covers both parties where the market allows it, & the choice has to be made before the print run rather than after.

What a notification record contains

The record is a structured summary rather than the full technical file. It normally captures the product name as it appears on the pack, the product category, the name & address of the party accountable in the market, contact details for that party, the identity of the person or company that submitted the notification, the framework formulation or an equivalent description of the composition, any presence of nanomaterials, any presence of substances with a restricted position, & a photograph of the label that the consumer will see.

Two fields cause more back-&-forth than the rest. The first is the product category, because a category chosen loosely can change the questions the system asks & the assumptions made about the product. The second is the label image, because it has to be the artwork that is actually printed, & a mock-up with a placeholder address is not the same document as the finished pack.

The submission details also matter commercially. The record normally names who submitted the filing, & a change of consultant or of importer can mean a change to that field. Keeping a copy of every confirmation with the batch records, rather than only in a consultant's system, is the difference between answering a question in an hour & asking a third party for a login.

Who submits it & what the market party does

Submission itself is an administrative act that a brand, an importer, a distributor or a specialist service can perform. What cannot be delegated away is the party accountable in the market. That party has to be named, has to be reachable, & has to hold the product information file & be able to answer questions from the authority about the product's safety.

For an imported product, the brand outside the market usually cannot occupy that position directly, & appoints either a United Kingdom entity or a service provider that is prepared to hold the file. A distributor that places the product on the market under its own name can occupy the position, which is common where a distributor already handles the brand's whole range in that market.

Whichever arrangement is chosen, the questions to settle in writing are the same. Who holds the file, who pays for a safety assessment, who answers an authority letter, who tells the brand when a restricted substance changes, & what happens to the arrangement if the commercial relationship ends. Those five answers belong in an agreement rather than in an exchange of emails.

What has to be true before the product goes on sale

Notification is a pre-market step. It is completed before the product is offered for sale, & offering for sale includes the first live listing rather than only the first physical shipment into a warehouse. A brand that schedules notification for the same week as the launch is running the launch on the assumption that nothing will need to be corrected, & corrections are common on a first filing.

The same period is when three other items should be in place. A product information file held by the party accountable in the market. A safety assessment covering the product as it will be presented, including its claims & its pack. A label that carries the required party's details, the ingredient list, the nominal content, the batch code & the date information in the form the destination expects.

Where the product contains a high proportion of alcohol, or where a fragrance compound is present, two further technical points come into play. Fragrance allergens above the applicable threshold need to be declared on the pack, & a compound's own declaration is not a substitute for the level in the finished product. Alcohol-based formats also bring flammability labelling, a flash point that determines how the goods may be shipped, & transport documentation a forwarder will ask for before accepting a booking.

The fields that are easiest to get wrong

The formula description is the first. A brand buying a proven base may never have seen a breakdown of the composition, & a summary written from the marketing name of a blend does not give the assessor or the authority what they need. The practical route is a composition breakdown from the factory in a shareable form, with the fragrance split out, because the fragrance carries its own labelling consequences.

The second is the product name. Where the pack name, the catalogue name & the name on the notification differ by even a suffix, the record no longer points unambiguously at the product on the shelf. Locking one name across artwork, listing & filing, & reading any change as a filing event rather than a marketing decision, prevents a mismatch that is difficult to explain afterwards.

The third is the pack image. Submitting a design mock-up is common & is usually a mistake, because the finished artwork often differs in an address line, a net content or a date format. The fourth is the framework formulation field, which a brand may complete from an older version of the formula. Both errors share a cause: the filing was prepared from design files & memory rather than from the released pack & the current formula version.

Reformulation, renaming & when to notify again

A change to the formula, the product name, the packaging that affects the product, or the party accountable in the market is normally a reason to look at the notification again. Whether that means a fresh filing, an amendment or simply a note in the file depends on the market's practice & on the nature of the change, but the decision should be recorded either way, because the question an authority asks is what the brand knew & when.

Three change types are routinely under-reported. A fragrance level adjustment made for cost reasons, which can move a component across a labelling threshold. A change of pack material, which affects compatibility & therefore the safety assessment. A change of fill volume, which changes the nominal content & the label, & which is frequently made late in a project to hit a price point.

The commercial argument for reporting these is not only about compliance. A distributor that discovers a formula has changed without the filing being updated loses confidence in the whole range, & that is a slower loss to recover than a delayed shipment. Building the notification review into the change control process, so that no formula is released to production until the file has been checked, is the cheapest way to avoid the conversation.

Northern Ireland & the dual-route question

The position in Northern Ireland is the item most often missed by sellers who think in terms of two markets rather than three. Under the arrangements that apply there, products placed on the market in Northern Ireland follow the European notification route rather than the United Kingdom one, which means a brand may need a European filing to supply Northern Ireland & a United Kingdom filing to supply Great Britain.

The practical consequence for artwork is significant. Where the same product is supplied into both, the party named on the pack may differ between them, & a single address block cannot always cover both cases. Brands selling on marketplaces with fulfilment across the whole of the United Kingdom should decide early which arrangement they are running, because the answer changes the artwork, the filings & the file-holder appointment.

It is also worth noting that the two routes have separate systems & separate confirmation documents. A brand that keeps a single spreadsheet with a column for each route, & the confirmation reference for each, answers the question in seconds. A brand that keeps confirmations in email threads answers it in days, usually at the worst possible time.

Comparing the United Kingdom & European set-up

The table below compares the two arrangements on the points that decide cost & timing for an imported product. It is a relative comparison of effort rather than a statement of any single market's rules, & the position for a specific product should be confirmed with a qualified advisor.

Read the table as a comparison of arrangements rather than as a legal summary. The point of the exercise is that a brand should be able to state, for each destination it sells into, which system holds its filing, which party is named on the pack & where the product information file sits.

Records worth keeping after the filing

Five documents do most of the work. The notification confirmation with its reference & date. The released artwork that was submitted, kept as a version rather than overwritten. The current formula version that the filing describes. The composition breakdown as sent to the assessor or the nominated party. Any correspondence about a change, including the decision not to refile.

Keeping these with the batch records rather than in a separate compliance folder matters more than it sounds. When a retailer or an authority asks about a specific batch, the question is usually about the product as it was made, not as it is now, & a brand that has overwritten its old artwork file cannot answer it. Versioned artwork files cost nothing to maintain & are close to impossible to reconstruct.

A useful discipline is a single page per product that lists the filing reference for each destination, the party named in each, the date of the last review & the reason for it. One page per product replaces a lot of searching, & it is the page a buyer or an advisor will actually want to see.

What to put in the brief

Say that the product is going to the United Kingdom, & say whether Northern Ireland is in scope, because the two answers lead to different arrangements. Name the party that will be accountable in the market, or say that the appointment is still open. Confirm that a composition breakdown in a shareable form can be released, since that single document gates the assessment & the filing data.

  • The destination markets, including whether Northern Ireland is being supplied.
  • The intended party accountable in the market, & who will hold the product information file.
  • The product name as it will appear on the pack, in the catalogue & in the filing.
  • The composition breakdown available from the factory, & whether it can be shared under agreement.
  • The fragrance compound, its allergen declaration & the intended level in the finished product.
  • The pack format, fill volume or unit count, & the nominal content to be declared.
  • Whether any alcohol content brings flammability labelling or a transport restriction.
  • Who reviews the filing when the formula, name or pack changes, & how that review is recorded.

Then agree the change routine. Any formula adjustment, fragrance level change, pack change or name change should pass through one person who decides whether the filing needs to move, & that decision should be written down. A filing that is maintained by habit rather than by process tends to drift out of step with the product within two seasons.

Where our capability fits

We prepare the documents that sit behind a notification: the composition breakdown in a shareable form, the process description, the raw material specifications, the safety data sheets, the fragrance declaration from the fragrance house, the pack compatibility position & the stability summary behind the shelf life claimed. We also state clearly which items in a United Kingdom launch are not ours to file, so a brand can see the lead times before it fixes a launch date.

We work with brands on private label (your brand on a proven base), OEM/ODM contract manufacturing & full custom formula development, & the document set is assembled during sampling rather than after approval. Our lines include a Moroccan argan hair oil, a smoothing hair oil capsule & a vitamin E & licorice serum softgel, each documented for the markets it is sold into.

Tell us which parts of the United Kingdom you are supplying & who will be named on the pack, & we will come back with what we can issue, what an appointed party has to obtain, & where a lead time has to be built in. Start at our inquiry page, email capsulebiotech@163.com, or message the right team on WhatsApp: Capsule Series (capsules only) +86 158-7655-5319, Cosmetics Series (serum, hair care, body care, fragrance) +86 158-7655-5319. The two systems compared side by side are covered in our article on United Kingdom & European notification, & the labelling fields in our guide to labelling by market.

General manufacturing information, not regulatory or legal advice. Notification systems, the identity of the party accountable in a market, filing data & timing, & the position of Northern Ireland vary over time, so the applicable requirements should be confirmed with a qualified advisor before a product is placed on sale.
