Selling Capsule Skincare in Latin America: ANVISA, COFEPRIS Basics for Importers

Latin America has become one of the fastest growing destinations for skincare imports, and Brazil and Mexico anchor most of that demand. For single-dose capsule formats the sales pitch travels well: sealed freshness, protection from light, precise dosing, no preservatives in the fill. Regulatory entry, however, follows two very different playbooks in the region, and brands that assume one uniform process often lose months at customs.

This guide outlines what each market asks of an imported capsule skincare line, so buyers can plan claims, labels, and timelines before committing to a first production run.

Brazil: Notification First, Registration for Functional Claims

ANVISA classifies cosmetics by risk under RDC 907/2024. Grade 1 covers basic skincare products with no functional claims and follows a simplified notification called Notificação: the local partner submits product data through the official system, receives a notification number, and the product can be marketed without waiting for pre-approval. Grade 2 covers products making specific claims such as sun protection or skin whitening, plus children's products, and requires full registration with safety and efficacy evidence, a process that typically takes six to twelve months.

Foreign brands cannot file directly. You appoint a Brazil-based legal representative, and your importer must hold the sanitary operating license known as AFE. Labels need Portuguese content, INCI ingredient names, and compliance with the Mercosur positive lists for allowed ingredients. Brazil also completed a nationwide ban on cosmetic animal testing in 2025, so safety data must come from accepted alternative methods.

Mexico: Establishment Notices, Not Product Registrations

COFEPRIS takes a different route. Cosmetic products themselves need no pre-market registration in Mexico. The procedural step sits with the business: importers and distributors file an Aviso de Funcionamiento, a notice of operation, before they begin regulated activity. Enforcement is largely post-market, which means labeling defects and documentation gaps surface at customs rather than in an approval queue.

Labels must follow NOM-141-SSA1/SCFI-2012 with Spanish content, responsible party details, batch codes, and usage instructions. Manufacturing should align with the GMP standard NOM-259-SSA1-2022. One rule deserves special attention: claims must stay cosmetic. Any suggestion of treating a condition pushes the product out of the cosmetic category and into the pharmaceutical pathway, a far heavier burden.

What This Means for a Capsule Line

Capsule formats are actually well suited to both regimes, provided the product concept is planned with the rules in mind. Note that both agencies run post-market surveillance as well, so the dossier you prepare on day one remains a living document for the life of the product:

  • Claims decide the grade. Keep launch claims to moisturizing, cleansing, or beautifying functions to stay in the fast Brazilian notification lane, and reserve functional actives for a phase two registration.
  • Sealed single doses simplify safety files. A preservative-free fill in an opaque shell reduces the variables a toxicological assessment must cover.
  • One core formula can serve both markets. Fill weight, shell material, and shell color stay constant; only artwork, language, and claim wording need localization.
  • The local partner is the long pole. Representative appointment and importer licensing take longer than production, so start that search before placing the manufacturing order.

Bringing a capsule skincare line into Brazil or Mexico is a documentation exercise as much as a manufacturing one, and getting the sequence right protects your launch window.
